📄 Terms & Conditions of Website Use

1. About the Website

Welcome to www.talentacademy.com.au (the "Website"). The Website provides access to services such as in-person and virtual training, coaching, and workshops (the "Services").

The Website is operated by Talent Academy (Australia) (ABN 92 620 759 182), Suite 110, 147 Pirie Street, Adelaide SA 5000. Access to and use of the Website and Services is subject to the following Terms and Conditions (“Terms”). By using or browsing this Website, you agree to be bound by these Terms. If you do not agree, please discontinue use.

We may update these Terms at any time, with changes taking effect from the date they are published.
 

2. Acceptance

You accept the Terms by continuing to use the Website or by actively accepting them where prompted (e.g., via checkbox or agreement button).
 

3. Services Access

We no longer offer an online school. Services are provided either in-person or virtually (via live delivery), with no recurring subscription or lock-in contracts.

In registering or booking services, you may be required to provide accurate personal information including:

  • Email address

  • Full name

  • Phone number

You must be 18 years or older to use our Services unless a guardian is present and consents to minor participation for special events.
 

4. Client Obligations

By using our Services, you agree to:

  • Provide accurate and current information

  • Maintain the confidentiality of any login or access details

  • Use the Website and Services lawfully and in line with these Terms

  • Not use the Website to promote third-party services or send unsolicited material

  • Refrain from interfering with the Website's functioning or using it in a harmful way
     

5. Payment

Most clients are invoiced after services are delivered, with payment due upon invoice. For ticketed events, payment is made at the time of booking. We accept:

  • EFT

  • Stripe (via invoice)

  • Credit Card

  • Direct deposit
     

6. Cancellation Policy

If you cancel with less than 12 hours’ notice or do not show up for a confirmed booking, a $100 cancellation fee applies. This fee is a genuine pre-estimate of the cost to Talent Academy. Exceptions may be considered in emergency situations.

This policy does not apply to events paid in advance (these are subject to Humanitix’s refund terms).
 

7. Intellectual Property

All materials (resources, recordings, slides, exercises, etc.) remain the intellectual property of Talent Academy. Clients may receive access to materials via email or secure links, for personal use only.

No part of our content may be reused, distributed, or published without written permission.
 

8. Privacy & Data

We collect personal and sometimes sensitive data for the purpose of service delivery. This includes:

  • Session recordings (for your review only)

  • Use of AI tools such as Yoodli, which may store feedback and video content securely

9. Photography & Recordings

By participating in workshops, you consent to being photographed or recorded for:

  • Personal development (session replays)

  • Marketing (general session content only, not sensitive work)

Consent is obtained separately at the time of booking.
 

10. Disclaimer & Limitation of Liability

Use of Services is at your own risk. We provide no guarantee of specific results. We are not responsible for indirect, consequential, or incidental damages. Liability is limited to the resupply of the service.

11. Jurisdiction

These Terms are governed by the laws of South Australia, and any disputes will be heard in South Australian courts.
